Legal – Design Registration Notice
This product is protected under Registered Design RSA Des. Reg. No.: F2020/01179, registered in terms of the South African Designs Act 195 of 1993. The registered design covers the visual appearance, shape, configuration, and overall form of the product.
Exclusive Rights
As the registered owner, we hold the exclusive legal right to:
- Manufacture the protected design
- Import the protected design or any product substantially similar to it
- Market, sell, distribute, or offer the protected design for sale
- Authorise others to use or produce the design
No third party may reproduce, imitate, copy, adapt, reverse-engineer, or base a competing or alternative product on this design without our explicit written permission.
Infringement Is a Legal Violation
Any unauthorised manufacture, importation, sale, distribution, marketing, or display of any product that copies or closely resembles this design constitutes design infringement under South African law.
We actively monitor both online and physical markets for infringement.
Consequences of Infringement
We will initiate immediate legal enforcement against any infringing party, which may include:
- Urgent interdicts (court injunctions) to stop further use or sale
- Seizure and destruction of infringing stock, tools, moulds, digital models, or associated production assets
- Claims for financial damages including:
- Loss of profits
- Legal costs
- Additional punitive damages where applicable
Where warranted, infringement actions may also extend to retailers, resellers, suppliers, importers, and manufacturers involved in the supply chain, whether knowingly or unknowingly participating.
Ignorance of this protection does not eliminate liability.
